Serving as Chicago’s Mercy Hospital’s general counsel underscores Judge Whiting’s varied experience and extensive background in healthcare law. Judge Whiting represents hospitals, individual physicians, and physician groups in complex regulatory, licensure, and commercial litigation matters, in state and federal courts, and before administrative bodies. He also advises hospitals and other healthcare entities on operational, administrative, and compliance matters, as well as on medical staff organization, governance, bylaws, peer review, and internal investigations.

From administrative hearings and bench and jury trials to appeals, Judge Whiting provides general and specialized litigation services for his health care clients. He litigates a broad range of business disputes, as well as managed care, insurance, and commercial actions. Judge Whiting also defends medical and general negligence actions and government investigations. He is counsel of record in numerous appellate court decisions.

  • Serving as general counsel for Mercy Hospital, responsible for a $2 million legal budget and all legal matters for the hospital including: advising on medical staff organization; governance; peer review; employment matters; contract negotiation; risk management; and internal investigations.
  • Representing the medical practice of Dr. John A. Hefferon, a prominent orthopedic surgeon and former team physician for the Chicago Bulls.
  • Successfully defending several Advocate Health Care affiliated hospitals in numerous medical and general negligence actions.
  • Negotiating, drafting, and reviewing health care transaction contracts, vendor agreements, physician employment contracts, independent contractor agreements, and non-competition and non-disclosure agreements for medical providers.
  • Representing hospitals in breach of contract, insurance coverage, employment, and general negligence claims.
  • Defending and resolving claims brought against local community hospitals by and before the Illinois Department of Professional Regulation.
  • Representing Roseland Community Hospital in several medical negligence actions for injuries ranging from the loss of body parts to death.
  • Successfully defending dozens of physicians insured by the Illinois State Mutual Insurance Society in medical negligence actions.
  • Representing Yates Enterprises, a company comprised of Yates Hair Science and Yates Metal Detectors in all corporate, regulatory, and litigation matters.
  • Successfully defending a national managed care company that constructed, opened, and operated a large surgery center prior to obtaining the appropriate state licensure by persuading the State of Illinois Departments of Professional Regulation and Public Health to grant the company an operating license and to waive a significant fine.
  • Spearheading Roseland Community Hospital's successful appeal to the Illinois Department of Public Aid regarding its prospective payment rate for operating costs related to patient care or other allowable costs.
