Mr. Whiting handles commercial litigation matters for domestic and foreign clients, in state and federal courts, at the trial and appellate levels, as well as in arbitrations and other forms of alternative dispute resolution. He represents both plaintiffs and defendants, is a veteran of several jury and bench trials, and has represented clients in parallel civil and administrative proceedings.  His representation includes, but is not limited to the following areas:

Following are examples of his work:

• Obtained summary judgment in defense of a United Kingdom-based investment company in a multi-million dollar intellectual property claim concerning an investment formula/computer program brought against the company in the United States District Court for the Northern District of Illinois.

• Represented a large national bank in a claim brought by a film producer for the bank’s denial of the producer’s loan application submitted in conjunction with a state of Illinois funded and sponsored program promoting the state as a motion picture filming location.

• Successfully defended a large, family owned, Springfield, Illinois based construction company in a series of multi-million dollar workers’ compensation/labor claims.

• Negotiated a favorable settlement for a Polish vodka manufacturer in a copyright infringement claim brought by a competing, world-renowned manufacturer.  Through Mr. Whiting’s efforts, the Polish manufacturer was able to continue producing, marketing, and selling its products in its markets of choice, preventing the loss of millions’ of dollars in revenue.

• Assisted with the settlement of more than 20 multi-million dollar wrongful death claims brought by the families of 21 deceased patrons killed in a nightclub stampede against a national entertainment, radio station, and outdoor advertising company, the alleged sponsor of event at the nightclub.

• Successfully defended a government owned, foreign flag aviation freight carrier sued by the purchaser of a multi-million dollar custom manufactured machine destroyed after falling from a truck during transit at O’Hare International Airport.

Insurance/Personal Injury

Mr. Whiting represents insurance companies, hospitals, and physicians in medical and other negligence actions. He also defends manufacturers in product liability claims. He has represented London Insurance Market insurers and syndicates in lawsuits, as well as other foreign and U.S. based insurance companies, including one of the preeminent Chicago-based physician insurers, in a variety of negligence and insurance related claims.

Following are examples of his work:

• Represent a hospital located on the far south side of Chicago in several medical negligence actions for injuries ranging from necrosis of a finger, allegedly resulting from negligent emergency room treatment, to death, allegedly resulting from negligence during a nursing/physician shift change.

• Successfully obtained summary judgment on behalf of a faith based multi-hospital system’s hospital in a premises liability action brought by a surgeon severely injured in a fall on the hospital’s premises.

• Successfully represented dozens of physicians insured by the Illinois State Mutual Insurance Society in medical negligence actions with injuries ranging from urinary tract infections, to amputations, to death.
